NOTICE: This document outlines the mandatory legal terms, conditions, and waivers governing a student’s enrollment and participation in Kids On Stage, Inc. programs. All Policies and Releases below are mandatory for participation. By completing and submitting the separate KOS Intake Form and finalizing enrollment, the undersigned Parent or Legal Guardian (the “Guardian”) acknowledges and agrees to these terms and conditions in their entirety.

SECTION I: LEGAL AND FINANCIAL AGREEMENT

1. GUARDIAN REPRESENTATION

The Guardian confirms they are the legal parent or guardian of the registered Minor (the “Student”) and possess the legal right to consent to, and by enrollment, they hereby do consent to, the terms and conditions of this Business Waiver/Terms of Service.

2. PAYMENT, FEES, AND POLICIES

The Guardian agrees to the following payment and administrative terms:

• Full Payment: Full payment is due before any class or camp begins.
• Late Fees/Returned Checks: There will be a $25.00 charge for late or returned checks. In the case of late payment, KOS reserves the right to give the spot to other campers on the waiting list.
• Installment/Auto-Pay: If enrolling in an installment/auto-pay plan, the Guardian gives KOS permission to automatically run the credit card on file on the specified date(s). The Guardian agrees to keep the credit card on file current at all times. A late fee will be applied if payment is unable to go through on the agreed schedule. Payment must be paid in full before the last day of the Student’s program.
• Prorating: There is no prorating for time off, which includes sickness, family vacations, special events in the child’s life, or anything else that necessitates the child’s absence once enrolled.
• KOS Cancellation Right: KOS reserves the right to cancel a class or camp at any time if enrollment is insufficient. Refunds will be pro-rated. Tuition may be applied to movement to another class or future programs, as per the parent’s agreement.

3. REFUND POLICY (MANDATORY AGREEMENT)

The Guardian understands and agrees to the following specific refund and cancellation terms:

• In-Person Class or Camp: Should the Guardian withdraw starting 7 days prior to the first day, a refund or optional credit (for a future class/camp) will be issued minus $140.00 ($100 non-refundable deposit, $40 non-refundable registration fee). After this period, there will be no refunds.
• Parties: Should the Guardian cancel a party 7 days prior to the party date, a refund or optional credit (for a future party, class, or camp) will be issued minus a $100.00 non-refundable and non-transferable fee.
• Private Coaching: No refunds are provided. Make-ups may be possible based on the teacher’s schedule and availability.
• Virtual Programs: There are no refunds or credits except for documented medical emergencies, from which appropriate arrangements will be made.

SECTION II: LIABILITY WAIVERS AND HEALTH CERTIFICATION

4. GENERAL ASSUMPTION OF RISK AND WAIVER

The Guardian certifies that the Student is in good health and can participate in program activities. The Guardian acknowledges that all KOS programs involve a risk of accident and willingly assumes that risk. I hereby release and hold harmless KOS and its employees from any and all liability that may arise out of my child/ward participation at class/camp. I acknowledge that I am responsible for any and all medical expenses due to my child/ward’s illness or injury.

5. PERSONAL AND PROPERTY RESPONSIBILITY

The Guardian will be responsible for any personal or property damage incurred by the Student while at KOS. KOS is not responsible for personal belongings lost or damaged by casualty, theft, etc. I agree to accept full responsibility, financial and otherwise, for the conduct of my child. This includes any damage to KOS property (props, sets, equipment).

6. AUTHORIZATION TO TREAT A MINOR (EMERGENCY CONSENT)

I authorize the KOS staff to attend to any health problem or injury my child/ward may incur while attending class/camp. I consent to any x-ray examination, anesthetic, medical or surgical treatment rendered by any member of the medical or emergency department staff licensed under the provisions of the Medicine Practice Act or Dentist licensed under the provisions of the Dental Practice Act. It is understood that this authorization is given in advance of any specific diagnosis, treatment, or hospital care deemed advisable by the aforementioned physician in the exercise of his best judgment. It is understood that effort shall be made to contact the undersigned prior to rendering treatment, but that none of the above treatment will be withheld if the undersigned cannot be reached.

SECTION III: COVID-19 WAIVER AND ASSUMPTION OF RISK

7. COVID-19 WARNING AND RISK

The Guardian understands that COVID-19 is a reported, extremely contagious worldwide pandemic. The Guardian acknowledges that KOS cannot prevent the Student from becoming exposed to, contracting, or spreading COVID-19 while utilizing KOS’s services. Therefore, the Guardian chooses to accept the risk of contracting COVID-19 for themselves and/or their children in order to utilize KOS’s services at any location.

8. WAIVER OF LAWSUIT/LIABILITY (COVID-19)

I hereby forever release and waive my right to bring suit against KOS and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing KOS’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence.

9. CANCELLATION DUE TO COVID-19

For In-person Park and Backyard Programs: I understand and agree that if an in-person class is canceled due to Covid-19 issues, KOS may move the class to a virtual platform or, when possible, an agreed upon make-up schedule day will be announced. There are no refunds or prorates for classes canceled, postponed, or missed due to such scheduling issues.

10. CHOICE OF LAW (COVID-19 DISCLAIMER)

I understand and agree that the law of the State of California will apply to the above COVID-19 disclaimer and contract.

SECTION IV: PROGRAM RULES AND CONDUCT

11. PLAYER’S RULES (CODE OF CONDUCT)

The Parent/Guardian and the Student(s) agree to the following mandatory rules:

• Mutual respect is required at all times.
• Supervision: Students must be supervised at all times and are required to stay with a KOS staff member at our theater and park locations.
• Backyard Theater Pods: A responsible adult must be present on the premises during the full class (no exceptions). This adult is responsible for any child picked up late.
• Respect for Property: We are guests at the locations where our classes are held. No touching props, sets, or any equipment without prior permission. Misuse results in having to replace items at your expense.
• Facility Rules: No running indoors or around the property. While waiting before or after your program, all KOS clients must keep their voices to a whisper. No phone calls indoors.
• Food/Drink: Eating, including gum chewing, and drinking inside the theater is strictly prohibited, with the exception of water.
• Dismissal: KOS reserves the right to dismiss any player or parent/guardian who does not respect any/all rules.

12. DROP OFF, PICK UP, AND LATE FEE POLICY

• Drop Off: KOS and any location personnel are not responsible for your child if they are dropped off without the appropriate KOS representative. You agree to never leave your child alone at any location.
• Late Fee (General): There is a 5-minute grace period after any class/camp. After the grace period, a $2.00 per minute late fee will be charged and strictly enforced.
• Late Fee (Backyard Theater Pod): An assigned responsible adult (per the host/group) will be on the premises during class time at all times. The teacher will be unable to wait. In the case of any extreme emergency, there is a late fee of $1.00 a minute starting immediately after the end of class time which will be strictly enforced.

SECTION V: MEDIA AND COMMUNICATION TERMS

13. PHOTO & VIDEO RELEASE (KOS PROPERTY)

I hereby consent to the photographing, recording or reproduction of any other manner of the likeness, voice and or activities of my child. I understand that all pictures and videos taken for any KOS programs or in connection with KOS are the sole and exclusive property of KOS and may be used by KOS for all promotional materials (print and online media purposes). KOS will never mention any student’s full name without prior consent. I further authorize Kids On Stage, Inc. to make unlimited use of reproductions. I understand I will not receive any monetary compensation, now or in the future for participating.

OPT-OUT CLAUSE: If the Guardian wishes to withhold consent for the public use of their Student’s media for promotional purposes, the Guardian must notify KOS in writing at the time of enrollment.

14. AUTOMATED SMS/TEXT MESSAGE COMMUNICATION

Consent is granted as a standard term of enrollment for operational messages. By providing a mobile number on the intake form, the Guardian consents to receive automated text messages from Kids On Stage, Inc. (“KOS”) regarding the Student’s enrollment, including class reminders, schedule changes, urgent safety alerts, and account/tuition updates.

Important Disclosures for SMS Communication:

• Message Frequency: Frequency will vary depending on your student’s active enrollment.
• Message and Data Rates: Standard message and data rates may apply. KOS is not responsible for any fees charged by your mobile carrier.
• Opt-Out: The Guardian can revoke this consent at any time by replying STOP to any message. A single confirmation message will be sent to confirm the opt-out. Reply HELP for support.
• Privacy: KOS ensures that mobile information will not be shared or sold to third parties or affiliates for marketing/promotional purposes.

ACKNOWLEDGMENT OF TERMS

By signing the separate KOS Intake Form, the Parent/Legal Guardian certifies that they have read, understood, and accepted all the provisions of these Terms and Conditions of Enrollment.
